The Company carries out its services in two ways as defined below,
1) End Solution of the Customers: This services means the services being rendered under Call Thekedar or callthekedar.com (Hereinafter referred as ‘The Company’) or though any franchisee/Branch/Service Provider etc. with the consent in writing of the above company by the expert engineers for the services mentioned at the home page of the website of the Company and the company renders this service only within the radius of 100 KM from the Company’s head office or under any Contract in writing or the company on its wish as the case may be, in any part of India.
2) Express Services: This service means the services being rendered through the third party like Contractors, Local Service providers, Vendors, Specialized Agencies etc. (Hereinafter referred as ‘The Third Party’) registered with the company, Who opt the company’s e commerce platform i.e. calthekedar.com for the promotion of their business under the terms and conditions defined separately in the website in the ‘Express Services’.
3) Classified Services We act as a venue to allow our users who comply under the terms and conditions of the company to offer, sell, and buy products and services listed on the Platform. Although you may be able to conduct payment and other transactions through the Platform, using third-party vendors such Call Thekedar or callthekedar.com is not in any way in involved in such transactions. Liability Clause:
1. The liability of the company towards the customers of the third party service providers under the Express Services is only limited to the recommendation of the best and most popular service provider in the customer’s locality.
2. The end solution of the complaint/problem is only given by the ‘Third party’. The company does not take part in rendering the services as well as in the profit of the third party benefits. The company only renders it’s services directly with the customers after entering into the contract with them.
3. Likewise above the company also not responsible in any case arisen in the course of service, before the service , after the completion of the services, Delay of the services, the Professional and personal behaviors of the Third Party Service provider registered with the Company with the customer /Complainant i.e. The company only recommends both sides, to the customers and the third party service providers by the help of its available data base, as the customer requires for the services by using the company’s e-commerce web portal. We do not take part in the actual deal that takes place between the users, contractor or supplier and hence are not a party to any contract between users, contractor or supplier. All liability regarding to the services and the conduct of the third party will be the responsibility of the users/contractor/ supplier/ advertiser only i.e. the third party.
4. Being an e-commerce portal, Call Thekedar cannot guarantee the identity nor the validity of the information which users post to our website. It is very important that you must satisfy yourself as to the true identity of anybody whose advertisement you respond to, or subsequently enter into a transaction/contract/agreement with them or make any sale or purchase with them.

FREE LOOK PERIOD
If you are a paid service member, you have the right to review the Terms & Conditions and cancel your candidature/ campaign on this Platform, within 7 working days from the date of your payment. If you choose to cancel your campaign, your refund will be processed as per Refund terms mentioned below and you will have to inform the grievance office of the company for the same at the above mentioned period of 7 days.
REFUNDS
1. The fee against the service paid in advance excluding other applicable taxes may be collected by Call Thekedar Services for the transactions booked through the Platform. If at any time, the Users are not satisfied with the quality of the Service Provider, User may call company’s grievance officer Mr Pradeep Kumar wherein the complaint will be noted for review. Call Thekedar Services holds the authority to decide if the charges should be refund for this compliant. Further, User will not have any right to claim or allege anything against Call Thekedar Services in respect of services provided/money collected by the Service Provider from the User beyond the service charge amount.
2. In any case should you in any manner wrongfully or illegally detain any director, employee, affiliate, agent, representative or subcontractor of Call Thekedar Services, we shall be constrained to take all such actions including cancellation of the refund process. Any refund will stand forfeited without any further reference to you. This shall be in addition to and without prejudice to all our further remedies at law.
GENERAL TERMS OF USE
Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the conditions of the Services without notice. 1. If any dispute, controversy or claim arises out of, or in relation to, or in connection with this Agreement or its termination or validity, the parties shall attempt to mutually resolve the same through mediation process.
2. However, if the parties fail to resolve the above dispute within a period of 30 days, the same shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
3. The arbitration shall be conducted by a sole arbitrator, appointed by Call Thekedar. The place of arbitration shall be in Rampur, UP, India and it shall be conducted in English.
4. The award of the arbitrator shall be final, conclusive and binding upon the parties.
5. The courts in Rampur shall have exclusive jurisdiction in relation to any dispute arising between the user/ service provider/ third party /member paid or unpaid/ /visitor,/ enterprise/ entrepreneur/ company with Call Thekedar.
6. The user/ service provider/ third party /member paid or unpaid/ /visitor,/ enterprise/ entrepreneur/ company agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of this Platform “callthekedar.com” or these Terms and Conditions, must be filed within one (1) year. Any claim or cause of action which may arise or is filed after a period of one year from the date of transaction shall not be entertained and shall be barred.
